Already Paid for a Fake Anya Hindmarch Bag ?

If you have already paid for a fake Anya Hindmarch bag
and would like to get your money back, this may help you

The first thing to do is contact the seller stating that you want a refund as the item is a fake and violates Ebay's policies

If you have paid with Paypal, you should also advise the seller that he or she should use the refund link which is in the actual Paypal transaction itself. This enables you to get your money back without paying a paypal charge to recieve it and also protects you from them doing what I am about to explain here.

If the seller does not respond or refund you, then I would send one more message stating that if you do not recieve the refund, you will raise a dispute with paypal and log a complaint with ebay for selling fakes. The hope is here that they will not want Ebay or Paypal to become involved and discover the fact that they are selling fakes. Hopefully this will get a quick solution.

If that hasn't worked, then Paypal's Resolution Centre to contact the seller. That can be found as you go into your paypal account. If that dosn't work then escalate it to a claim with Paypal. Paypal will then look into it and may ask you and or the seller for further information. This can take some time, so you will need to be patient. If Paypal decide against you, then there is something called a chargeback if you have used a credit card to fund the transaction through Paypal.

If they decided in your favour and the seller has money in their account, Paypal will take it from there and give it back to you. If there is no money in the sellers account, then you may never get it back through Paypal, even though they claim to do all that they can to do so. Paypal will advise you if they find in your favour, but there is no money in the sellers account. If you have funded Paypal for the transaction with a credit card, you can now do a chargeback.

What is Important about the Paypal process is that you follow all of Paypal's instructions and observe the timescales that they set. You need to opne the dispute within 45 days of making payment and then if you are going to escalate it to a claim, you must do so within 20 days of opening the claim.

Chargeback

A Chargeback is a bit of consumer protection built into a credit card (not debit card).

How it works is, you would get in touch with your card company and tell them either you did not recieve the goods or they are significantly different to how they were described. They will then tell you what they need you to do and want information they will require from you.

Unfortunately as a lot of Credit Card companies use call centres, not all the agents are fully clued up on every aspect of the card and may not know what a chargeback is. Try your best to explain and ask to speak to a supervisor or manager. If they try to tell you that they don't do chargebacks , they are wrong, it is not their choice, they are guided by industry regulations and have to do so, if the case meets the criteria. One of the criteria is the timescales after the transaction before you notify the card company. Try to do that as soon as possible.  I know for an item not recieved it is up to 120 days. Don't let them tell you any different, some try to quote 60 days, but they are getting mixed up with something else.

What will happen then, your card company will approach Paypal for their side of the story as well as listen to yours. Your card company will then determine if you are entitled to your money back. If they say yes, then paypal has to return it back to the card company, regardless of how they feel about it. What Paypal will do then, is make a bit more of an effort to get the money back from the seller as it is now their own money they are trying to recover. They will also charge a £7 admin fee to the seller as well.

You do not have to have used Paypal's Resolution process in order to initiate a chargeback, however, it is usually better to try through Paypal first as it is usually quicker and Paypal prefer it to try through them first. If you are outside of Paypal's 45 days, then you can go straight for the chargeback

It is worth noting that a chargeback is not restricted to Ebay.

If you have not used Paypal to pay for your item, then things are a bit more difficult as there is a lot less protection, which is why it is a lot safer to use eBay. Your best option is to use the dispute console in Ebay.
